Utah a state that
ranks number one in the nation for mortgage fraud recently had a trial
conclude. Dan Debenham as pictured above, has been on the radar
screen for numerous real estate fraud infractions and was the sole owner
of The Millionaires Investors Group, Inc. (TMIG). In his actions
to profit Mr. Debenham took $159,773 from three investors in 2005 with
total losses extending to slightly over $300,000.00.
On April 16, 2007
Daniel D. Debenham was sentenced by the Honorable Judge Ann Boyden to
serve 0-5 years in Utah State Prison for three 3rd degree felony
securities fraud convictions. But in a move that has stunned many, the
Honorable Judge Ann Boyden suspended Mr. Debenham's sentence in order to
allow him to pay back his victims.
Around the world all eyes have
followed the steps of Paris Hilton.
Will she go to jail or will her attorney be able to sidetrack the
judicial system into allowing yet another lifestyle of the rich and
famous to skate past the laws established by the people and for the
people.
But as consensus in
America continues to transform, We the People are asking - more
importantly demanding "Liberty and Justice for All."
Case in point there
have been numerous trials involving public figures to include senior
level executives at Enron, the on-going trial of media baron Conrad
Black and even more recent the formal public-corruption probe launched
by the FBI of Arizona Republican Senator Rick Renzi.
But even with such
headway the question of progress seems impeded by judicial review.
The Honorable Judge
Ann Boyden's office was contacted via telephone by Perfect Home Living
for comment but she nor representatives from her office have provided
a statement on the matter of Mr. Debenham or his stayed sentence.
"This goes to the
heart of the matter of why Utah ranks number one in mortgage fraud,"
says Sheri Fitzpatrick, CEO of Perfect Home Living. "There simply
is no fear factor. In essence Mr. Debenham not only robbed
consumers he also robbed the bank. So should we now say that any
bank robber that gets caught should be let go as long as they are able
to make full restitution payments?" Fitzpatrick continued.
Although the efforts
of the Attorney General's Office in this case were met with the
conviction in which they sought their work along with other law
enforcement agencies involved were completely over-ridden by the
undertone that criminals in Utah can escape prison sentencing, as long as
they can make restitution.
As quoted in the
April 17, 2007 Press Release from the Office of the Utah Attorney
General, Wayne Klein, Director of the Division of Securities sends this
warning to Utah's consumers, "Don't be fooled! Real Estate
investments which offer promissory notes and guaranteed profits are
securities."
**For many people that have been following this story, there has been
confusion as to another Daniel Debenham who is a respected and
successful co-owner and television executive for LENZworks Production. Mr.
Debenham of LENZworks Productions is not the same party and is not
affiliated in any way with the Daniel D. Debenham of the Millionaires
Investors Group, Inc. (TMIG) who was convicted as explained above.
